PERSONAL DATA PROTECTION POLICY

I. CONTROLLER OF PERSONAL DATA

   The controller of your personal data is the company operating under the name SALONTY Spółka z ograniczoną odpowiedzialnością with its registered office in Poznań (61-821), at ulica Ogrodowa 12, holding NIP: 783-176-84-63, REGON: 368915728, hereinafter: the Landlord or the Controller of Personal Data.

II. SOURCES OF PERSONAL DATA

1. 1.
   The Landlord processes only personal data that you provide voluntarily.
2. 2.
   The Landlord receives your personal data in connection with the process of making a reservation / concluding an agreement / registering for the performance of a service at the Venue, or as a result of you leaving that data by email, by SMS, through the internet portals with which the Landlord cooperates, or through other channels of direct communication.

III. PURPOSES AND LEGAL BASES FOR PROCESSING PERSONAL DATA

1. 1.
   The processing of your personal data is necessary for the Landlord to perform the agreement concluded with you / to handle your reservation / to handle the enquiries you submit.
2. 2.
   The law requires the Landlord to process your data for tax and accounting purposes.
3. 3.
   The Landlord also processes your personal data on the basis of the Landlord’s legitimate interest, which is:

   1. a. ensuring the delivery, security and settlement of the services / reservations and transactions relating to the services that the Landlord provides to you, including enforcing compliance with the rules on the Venue’s premises;
   2. b. handling your enquiries submitted to the Venue where they are not directly connected with the Landlord’s performance of the agreement;
   3. c. conducting research and statistical analysis of the Venue’s website, among other things with regard to its functionality, improving the operation of services and estimating the main interests and needs of visitors;
   4. d. conducting research and analysis of the internet portals that mediate in concluding an agreement with the Venue / registering for the service you have reserved, among other things with regard to its functionality, improving the operation of services and estimating the main interests and needs of visitors;
   5. e. debt recovery; conducting court, enforcement, arbitration and mediation proceedings;
   6. f. storing data for archival purposes and to demonstrate that the Landlord has fulfilled obligations arising from the law;
   7. g. processing your data as part of direct marketing of the Venue’s products and services, including sending commercial information on the basis of the consent you have given.
   8. h. contacting you by telephone, SMS or email on matters connected with handling the reservation, in particular in order to confirm the reservation, pass on organisational information, agree the details of the event or send a reminder about an approaching reservation date.
   9. i. conducting direct marketing of the Controller’s own services, in particular by telephone contact, SMS or email addressed to people who have previously used the Venue’s services, including in order to pass on information about special offers and discounts, to send a reminder of the anniversary of an event, or to invite them to use the Venue’s services again.

   The legal basis for the Landlord’s processing of your personal data is Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: the GDPR).

IV. CATEGORIES OF PERSONAL DATA PROCESSED

Depending on the purpose for which and the way in which the Landlord obtains data, it may ask you for the following personal data:

V. PROVIDING PERSONAL DATA IS OPTIONAL

   Providing your personal data is voluntary, but at the same time necessary for the performance of the services the Landlord is to provide to you, that is, handling your reservation or performing the other services covered by the agreement
2. 2.
   Consent to receive information about special offers, promotions, discounts and other marketing activities is also voluntary. The Landlord needs it in order to be able to send you its newsletter. If you do not consent to receiving these materials, the Landlord will not send them to you. You may change the consents you have given at any time.

VI. PERIOD OF PROCESSING PERSONAL DATA

1. 1.
   Above all, the Landlord stores your data until it has completed your reservation or the other service it is performing for you, and until the period connected with the possibility of the Landlord pursuing claims connected with the performance of services has elapsed.
2. 2.
   In addition, the data may be stored by the Landlord for the purposes of preventing abuse and fraud, and for statistical and archival purposes, for a period of 10 years from the day the agreement ceased to apply / the stay ended.
3. 3.
   In order to ensure the transparency of the business it conducts, the Landlord will store the data for the period in which the Venue is obliged to retain the data or the documents containing it in order to document that legal requirements have been met, including to allow public authorities to check that they have been met.

VII. THE CLIENT’S RIGHTS IN CONNECTION WITH THE PROCESSING OF PERSONAL DATA

In accordance with the GDPR, you have the following rights:

1. a. the right of access to personal data, under art. 15 GDPR;
2. b. the right to rectification of personal data, under art. 16 GDPR;
3. c. the right to erasure of personal data, under art. 17 GDPR;
4. d. the right to restriction of the processing of personal data, under art. 18 GDPR;
5. e. the right to portability of personal data, under art. 29 GDPR;
6. f. the right to object to the processing of personal data, under art. 21 GDPR;
7. g. the right to contest a decision based solely on automated processing, including profiling, which produces legal effects concerning the person or similarly significantly affects them, under art. 22 GDPR.

The scope of each of these rights from the provisions of the GDPR cited above. You may exercise the rights listed above by sending an application, or another kind of letter, to the Landlord’s correspondence address, or by sending an email.

VIII. THE RIGHT TO LODGE A COMPLAINT

If you consider that the conduct of the Controller of Personal Data or of entities acting on its behalf breaches the provisions on the protection of personal data, you have the right to lodge a complaint with the supervisory authority, that is, with the President of the Personal Data Protection Office.

IX. RECIPIENTS OF PERSONAL DATA

   The Landlord makes your personal data available only to those employees and associates who must have access to it so that the Landlord can thereby guarantee a high quality of service, both in performing your reservation / agreement / registration and in handling an enquiry.
2. 2.
   If the data you make available to the Landlord is processed by an external entity, this happens only at the Landlord’s instruction and on the basis of an agreement concluded by the Landlord with that entity. The Landlord does not make your data available to any external entities for their own use, only for the performance of the services provided by the Landlord. All entities that process your personal data ensure its security and fulfil all obligations in the area of personal data protection.
3. 3.
   Besides the Landlord’s authorised employees, access to the data may be held, among others, by the organisers of events included in the Landlord’s offer and by contractors providing the Landlord with management, accounting, marketing, IT and legal services.
4. 4.
   Where necessary, the Landlord may pass your personal data to public authorities, including law enforcement authorities combating fraud and abuse.

X. TRANSFERS OF DATA OUTSIDE THE EUROPEAN ECONOMIC AREA

Your personal data will be transferred by the Landlord outside the European Economic Area only where such a transfer of data is necessary for the Landlord to perform the agreement / registration concluded by you.

XI. AUTOMATED PROCESSING OF PERSONAL DATA

1. 1.
   Your personal data will be processed in an automated manner (including in the form of profiling), however this will not produce any legal effects concerning you or similarly significantly affect your situation.
2. 2.
   The Landlord’s profiling of personal data consists in processing your data (including in an automated manner) by using it in particular to analyse or predict personal preferences and interests.
